David Shestokas – who is paid for by the Citizens for a Better Normal- is still at the McLean County Clerk’s office as of Friday at 2:57 p.m. Shestokas made a motion to dismiss a “records check” …this is a combing through of near 2,200 signatures.
“I also object to the validity of the petition on the grounds that it does not contain enough valid signatures of electors…” says the objection filed by Patrick Dullard, a mutual friend on Facebook of mayor Chris Koos.
Shestokas ran for Attorney general and is a renown Illinois lawyer who represents the plaintiff in the current case, Illinois Conservative Union vs Illinois State Board of Elections. He has also worked in the Georgia run offs and has authored books like Constitutional Soundbites.
Chris Koos, Mayor of Normal, and Town Attorney Brian Day along with objector Patrick Dullard, president of the Friends of Constitution Trail, wanted to go forward with illegal records check. Why is illegal?
“Within the parameters of the law, the Normal Electoral Board will only consider written objections and the written specifications of those objections to the original petitions, as set forth in the objector’s petition. The objector’s petition cannot be amended. No answer or response to the objector’s petition need be filed.”
Brian Day is paid for via taxpayer dollars.
In Dullard’s objection he said, ““I also object to the validity of the petition on the grounds that it does not contain enough valid signatures of electors in the Town of Normal to meet the 5% threshold as cited in Section 3.1-25-80 cited by the Petitioners.”
Dullard said this prior to combing through these signatures.
A source tells us the Patrick Dullard objected to Kathy Siracuse’s signature and she is in the room at the McLean County Clerk’s office currently, as of Friday afternoon.
The Town of Normal held a hearing prior to this Records Check. Contrary to Rule 7, the Records Check is scheduled to be conducted before preliminary motions are heard.
The first motions were heard this past Monday, Aug. 22.
Shestokas has made a motion to dismiss the objection entirely… Dullard is trying to claim that Citizen’s for a Better Normal’s petition is defective based upon the use of the word “town” in the petition arguing that 65 ILCS 5/3.1-25-85 does not apply to an “incorporated Town”, and only to a village per 65 ILCS 5/1- 1- 4. Those numbers and jargon are state statues the readers of this article can hyperlink to. Essentially Dullard is claiming that because they use the word town…because apparently Normal is an “incorporated Town.”
But David squares off to the Goliath of Normal and countered the objection with Normal’s own Municipal Code that acknowledges that “village” and “town” are interchangeable.
“Any reference made to “city” or “village” shall mean the Town of Normal, McLean County, Illinois, unless the context clearly requires otherwise. Any reference to “city” officer or employee, “Village” officer or employee or town officer or employee shall mean one and the same and shall be deemed to be the officer or employee of the Town of Normal.”
The provisions of the Election Code are mandatory stating in relevant part: “The objector’s petition … shall state fully the nature of the objections to petitions in question …”
